These terms and conditions ("Terms") govern the use of services made available on or through https://www.touchhomeexpress.com and/or the Touch Home Express mobile application (collectively, the "Platform", and together with the services made available on or through the Platform, the "Services").
These Terms also include our Privacy Policy available on the Platform ("Privacy Policy"), and any guidelines, additional, or supplemental terms, policies, and disclaimers issued by Touch Home Express from time to time ("Supplemental Terms"). The Privacy Policy and Supplemental Terms form an integral part of these Terms.
These Terms constitute a binding and enforceable legal contract between:

(a company incorporated under the Companies Act, 2013, India)
(hereinafter referred to as "Touch Home Express", "THE", "we", "us", or "our")
AND
You, a user of the Services or any legal entity booking Pro Services on behalf of end-users ("you" or "Customer").
By using the Services, you represent and warrant that:
(a) The Platform enables users to arrange and schedule home-based services with independent third-party service providers ("Service Professionals").
(b) The services rendered by Service Professionals are referred to as "Pro Services."
Touch Home Express:
Service Professionals are independent contractors and are solely responsible for the services provided.
(c) The Platform is intended for personal and non-commercial use within India unless otherwise agreed.
(e) Communication Consent: You agree to receive SMS, email, WhatsApp, or other communications related to bookings, service updates, promotions, and payment notifications. You may opt out by writing to: info@touchhomeexpress.com
Touch Home Express may offer promotional credits ("THE Credits").
To use the Services, you must create an account ("Account").
You agree to:
(a) Orders: You may book Pro Services through the Platform by selecting available time slots.
(b) Confirmation: You will receive booking confirmation via SMS, email, or push notification.
(c) Cancellations: Cancellation fees may apply as per Touch Home Express cancellation policy.
(d) Substitution: If a Service Professional is unavailable, Touch Home Express may provide a substitute.
(a) Charges: You agree to pay Charges for Pro Services (payable to Service Professionals) and Convenience Fees payable to Touch Home Express.
(b) Payment Modes: Payments may be made via Credit/Debit Cards, UPI, Net Banking, Wallets, and Cash (where applicable).
(c) Taxes: All Charges and Fees are subject to applicable taxes under Indian law.
(d) Non-Refundability: Charges and Fees are final and non-refundable unless required by law.
(e) Surge Pricing: Charges may increase during high demand periods.

All intellectual property related to the Platform belongs to Touch Home Express or its licensors.
You are granted a limited, non-transferable, revocable license to use the Platform.
The Services are provided "AS IS" without warranties of any kind.
Touch Home Express:
Maximum liability shall not exceed: INR 10,000 OR Commission earned on the relevant booking (whichever is lower)
You agree to indemnify Touch Home Express against claims arising from:
These Terms shall be governed by the laws of India.
Courts in New Delhi, India shall have exclusive jurisdiction.
Disputes shall be resolved via arbitration under the Arbitration and Conciliation Act, 1996.

Touch Home Express may suspend or terminate your account for breach of Terms, unlawful conduct, or business/regulatory reasons.
